Rental Terms and Conditions
CUSTOMER AGREES TO BE HELD RESPONSIBLE FOR ANY AND ALL REPAIR AND LABOR COSTS

TO UNITS WHICH OCCUR IN CUSTOMER'S CARE.


• When renting some equipment we require an insurance binder on file during the rental period.

• A valid driver's license and major credit card are required to rent.

• All rental charges are to be paid in full prior to the start of the rental.

• Rent starts when the equipment leaves our shop and ends when it is returned or called off rent.

• Rental rates are based on an 8 hour day, 40 hour week, and 176 hour month. Double shift operations will result in charges of 1.5 times the rate. Triple shift operations will result in charges of 2 times the rate.

• Rates include normal wear not damage. Damage repairs will be charged at retail for parts and our shop’s current labor rate at the time of damage.

• Customers are responsible for damages incurred from theft, fire, and vandalism.

• Prices and equipment listed in this book may change at any time without notice.

The following are the terms and conditions that apply to the rental of equipment from Faris Rental, LLC. By accepting equipment furnished under this agreement, the customer whose name appears on this agreement, accepts and agrees to these terms and conditions. Equipment as referred to herein shall include to be delivered as specified on the attached invoice.

Warranty

With respect to rental service, Faris Rental, LLC warrants to the Customer only that rental equipment when delivered is in good operating condition. If equipment is not received in good operating condition due to no fault of the Customer, Faris Rental, LLC shall (at its option) either repair equipment or supply replacement equipment subject to availability form Faris Rental, LLC's inventory. Defects or discrepancies to equipment must be reported to Faris Rental, LLC within 2 hours after customer receives equipment. Failing to do so will mean that the equipment was as ordered, was received in good condition and is accepted. The Remedies provided herein are Customer's sole and exclusive remedies. In no event shall Faris Rental, LLC be liable for direct, indirect, special, Incidental or consequential damage (including loss profits) whether based on contract or any other legal theory. Farisl Rental, LLC makes no warren to expressed or implied that the equipment is fir for any particular purpose. Upon notice from Customer during the course, Faris Rental, LLC will, at its option, repair or recalibrate malfunctioning equipment.

Payment Terms

All rental are to be paid in full by the time of delivery or pickup of rental equipment unless otherwise agreed upon. Delivery/Pick
up

Faris rental equipment shall be delivered on Faris Rental, LLC's owned vehicles unless the Lessee has proper equipment to transport the specified piece of equipment. Faris Rental, LLC shall not be liable for delays in performance here under due to causes beyond its control including, but not limited to, acts of nature, acts of Government, labor disputes, delays in transportation and delays in delivery or non-delivery by Faris Rental, LLC's suppliers. Liability

Faris Rental, LLC shall not be responsible for loss or damage to Customer's business or property or for injury or death to persons; and Customer shall indemnify Farisl Rental, LLC and hold it harmless for claims for any of the foregoing, including associated legal fees and expenses. Default

Should Customer default in its obligations, Customer agrees to pay FarisRental, LLC for all costs and expenses incurred by Faris Rental, LLC for all costs and expenses incurred by Faris Rental, LLC in recovering equipment or monies due and enforcing its rights. The Customer shall be responsible for Faris Rental, LLC's legal fees and expenses whether or not formal legal action is instituted.

Notifications
Any required notices shall be given in writing at the address of Faris Rental, LLC or Customer as shown on the front of this contract or to such other address as

either party may substitute by written notice to the other.

Assignmen t

Neither Faris Rental, LLC nor Customer may assign or transfer any rights, duties, or obligations herein without prior written consent of the other, and any purported attempt to do so shall be null and void.

Waiver

Should Faris Rental, LLC choose not to exercise any of its rights, they shall not constitute or be deemed a waiver or forfeiture of such rights. Purchase Rights

Customer has no purchase rights or purchase options under this agreement.

Government Jurisdiction

Faris Rental, LLC shall be notified in writing of any binding U.S. Government procurement regulations that will affect this contract. This agreement shall be governed by the laws of the State of Connecticut.

Errors

Stenographic, typographic and clerical errors I this agreement are subject to correction and Customer hereby agrees to re-execute any document that requires correction or signature.

Rental equipment remains the property of Faris Rental, LLC. Customer shall not remove, deface, or obscure ownership labels. Rates

Rates are based on daily, weekly and monthly time periods. Rentals continue beyond the initial time period requested are billed at a daily rate, until that exceeds the weekly rate. Rental charges will commence when Faris Rental, LLC delivers the equipment to Customer. Rental charges cease on the day equipment is received at the designated Farisl Rental, LLC facility. There are no credits or rebates for early return unless otherwise agreed upon.

Equipment Usage

Customer shall not make any alterations, additions, modifications, or improvements to the equipment and shall use it only for the purpose and in the manner for which it was intended by the manufacturer. Customer may not permit the equipment to be used by another party of at a different location without express written consent of Faris Rentall, LLC.
